Permanent Residency (EB-1 to EB-5)

- EB-2:The EB-2 category is open to those who have earned advanced degrees in their fields or are foreign nationals with particularly impressive credentials. Because most EB-2 applicants have employment offers, businesses commonly submit the paperwork necessary for the PERM labor certification process. In addition, an employer must perform a labor market analysis to demonstrate that the prospective visa holder will not compete with American workers for jobs. PERM labor restrictions can be relaxed if the individual proves that his admission is in the national interest.
- EB-3:Professionals and other high-skilled employees can obtain an EB-3 status. Before an EB-3 applicant can begin the labor certification procedure, he usually needs a job offer.
- EB-4:The EB-4 category is reserved for "special immigrants" -- a select group of highly qualified immigrants. This category often includes Iraqi and Afghani residents, members of NATO forces and their spouses, religious workers, and others who have helped advance U.S. national interests.
- EB-5:The EB-5 category is open to foreign nationals who invest $1 million or more in a new commercial business that employs a minimum of ten American citizens. For a period of two years, investors in the EB-5 are granted conditional lawful permanent resident (LPR) status. For EB-5 investors to remove conditions on their LPR status, they must submit a new application with the USCIS after the two-year period.
